Terms of Use

These Terms of Use (“Terms”) govern your use of the W+ app for iPhone (“W+”, “the app”), developed by Rajkumar Sharma (“we”, “us”). By downloading or using the app, you agree to these Terms. If you don’t agree, please don’t use the app.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use W+ on Apple devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, resell or redistribute the app, except where the law allows it.

Your routines and history are stored on your device. You are responsible for keeping backups of your device. Our handling of information is described in the Privacy Policy.

4. Not medical advice

W+ helps you plan routines and build habits. It does not provide medical, health or fitness advice. Talk to a qualified professional before starting any exercise, diet, medication or health routine you add to the app.

5. Reminders and availability

We work to make reminders, widgets and Live Activities reliable, but their delivery depends on your device, its settings (such as Focus modes, notification permissions and Low Power Mode) and iOS. Don’t rely on W+ for anything time-critical or safety-related.

6. Acceptable use

Use W+ only for lawful, personal purposes and in line with these Terms and the App Store rules.

7. Disclaimer

The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We don’t guarantee that the app will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of the app. Our total liability for any claim is limited to the amount you paid for the app or W+ Pro in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.

9. Apple

These Terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation to the extent permitted by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo or listed as a prohibited or restricted party.

10. Changes and termination

We may update these Terms from time to time; the effective date above shows the latest version, and continued use means you accept the changes. We may suspend or end your licence if you breach these Terms. You can stop using the app at any time by deleting it.

11. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless the law of your country of residence requires otherwise.
